Mischa Barton will apparently escape doing time in prison after accepting a plea in her DUI case. People Magazine reports that she will plead no contest at her DUI arraignment this Thursday. In exchange, the pot possession charge has been dropped and the driving without a license charge has been reduced to an infraction.

Mischa will pay a fine of $1,700, complete a three-month alcohol-education class and serve 3 years of unsupervised probation.

Marijuana possession, drunk driving and driving without a license with no prison time? It’s good to be rich and famous.

 OC star Mischa Barton is rumored to have started dating Rooney guitarist Taylor Locke, after they were spotted kissing at a memorial gig for filmmaker Brandon Schantz at LA’s The Roxy Theatre. The actress also ate lunch with Locke earlier in the day.  Barton, 22, is known for dating rockers including Cisco Adler, front man for the band Whitestarr.

A source said: “Mischa was singing along and dancing as Rooney were playing. Literally as soon as they had finished she dashed over to the stage and gave him a big kiss on the lips.

“She was holding him around the waist and looked really happy.”

The band formed in 1999 and have released four albums together.

The new romance rumors come right after reports that Barton was dating Brett Simon. Simon is the director of her latest film, “The Assassination of a High School President” which co-stars Bruce Willis and Rumor Willis. Hey love is fickle.

TMZ is reporting that Mischa Barton  has been formally charged with four misdemeanor counts: driving under the influence, driving with a blood alcohol level of .08% or higher, driving without a license and possession of 28.5 grams of marijuana (a misdemeanor).

This all stems from her arrest in West Hollywood on December 27, 2007.  Mischa’s formal arraignment will be in the Beverly Hills courthouse on February 28, though she is not required to attend.  Will she the next celebrity to face time in jail? Probably not.

Mischa Barton phoned into Ryan Seacrest’s radio show this morning, and Ryan got her to talk about her DUI arrest last month.  You can listen to her interview with Ryan here.

She said of her arrest, which also included possession of prescription pills not made out to her and driving without a valid license:

“I was pulled over and obviously, I’m 100% responsible for my actions in this case. I’m really disappointed in myself.  I’m not perfect and I don’t intend to do anything this stupid again.”

Nice speech, let’s hope she follows through.

Former O.C. star, Mischa Barton, has reportedly ducked out of co-hosting the opening of a Las Vegas nightclub, just days after she was arrested for driving under the influence.
The actress was pulled over by West Hollywood cops in the early hours on Thursday when she was spotted straddling two lanes of traffic. Barton was taken into custody on suspicion of DUI, but was also booked for possession of narcotics and driving with a suspended license. Police source reportedly have said that Mischa blew a .12 on her breathalyzer, and admitted to smoking pot earlier on the day of her arrest.

Following her arrest, Barton has cancelled an appearance at the opening of Cathouse at the Luxor hotel on Saturday night (Dec 29).
A source tells PageSix, “Mischa can’t give interviews on the red carpet or deal with the press right now, so they told her she can’t do the event.” Barton is currently free on $10,000 bail.

Former “O.C.” star, Mischa Barton, appears to be in some trouble.  Barton has been arrested apparently for a DUI, possession of narcotics and driving on a suspended license. 
Barton was pulled over early this morning on the corner of La Cienega and Santa Monica Blvd as she was driving her white Range Rover in West Hollywood, Calif. at around 2:45 AM  and is still in custody, being held on $10,000 bail.
