Update: The Commissioner has ruled that Britney will not have visitation rights restored, at least until the next hearing on February 19.  That’s more then another month Britney won’t get to see her kids. The ruling came after damning testimony from several people, including two LAPD cops who responded to the standoff last week.

A mentally fragile Britney Spears finally did arrive at the the courthouse today for her ongoing custody battle with K-Fed. As she got out of her cars, she screamed at photogs,

“Move back. I’m scared. Stop it. Stop it.”

Brit managed to make her way into an underground tunnel, where she was met by two of her lawyers — Anne Kiley and Tara Scott. TMZ reports that they actually got into the Escalade to speak with her. That’s when Brit speculatively said she just didn’t want to testify. 

It’s a reasonable assumption as she didn’t go inside the courthouse and instead headed back to her car and drove away.  Fighting her demons she came back — and at one point got out of the SUV — but then got back in and drove off.

There was a lot at stake for Brit to appear before the judge today as we explained here but she just wasn’t up to the challenge of defending her right to see her children in her current condition.

The Spears family is now angry with Dr. Phil, as apparently his proir butt kissing has worn off. Though they haven’t said whether they gave Dr. Phil McGraw permission to see their daughter at the hospital or not they are calling the way he handled his contact with Britney a betrayal, inappropriate, and a total breach of their trust.

The Spears family rep Lou Taylor appeared on the “Today” show on their behalf and told Meredith Vieira that:

Dr. Phil actually broached the subject of doing a show about Britney, but that they nixed the idea, only to have Phil try to set up the show anyway. Taylor scorched Phil, saying it was even “inappropriate” for Phil to bring up doing a show, and that the family thought it would be detrimental to Britney.

What’s more, Taylor said that the family felt “betrayed” that Phil would issue any kind of statement after meeting with Brit, and that nobody had given him any authority to say anything, much less bellow on and on like he did.

Meanwhile Britney got slapped with a restraining order by the LAPD, according to People Magazine at the time of her meltdown Thursday and must stay at least 100 feet from Kevin Federline, according to the “emergency protective order,” which was issued to “stabilize the situation.” The order was confirmed by K-Fed’s lawyer Mark Vincent Kaplan, and was enforced for five business days – i.e., ending today. No word on whether it will be extended.  On Jan. 4, Spears, 26, was stripped of all visitation rights with sons Preston, 2, and Jayden, 1, pending the ex-couple’s next custody hearing on Jan. 14.

Britney Spears is sedated and resting in the psychiatric unit at Cedars-Sinai Medical Center. A family insider says that the singer requested that no visitors be admitted and her doctors agreed.  According to reports Jayden James, was not injured during the standoff at Britney’s house Thursday night and the bruise rumor is not valid. Jayden allegedly was taken to the hospital purely for “preventative reasons.”  Apparently, Britney will not be charged with any offense following the  stand-off with police on Thursday night at her Beverly Hills home.  At least for the time being the courts have realized that her children aren’t safe with her right now and have suspended her visitation rights.

With Britney’s visitation rights suspended by the courts until further notice there are still a few things to speculate on.

Among the mysteries that remain after Britney’s recent meltdown is why was Britney Spears’  son Jayden James Federline hospitalized this morning along with his hysterical mother.

Apparently The singer’s youngest son was taken to Cedars-Sinai Medical Center via ambulance because Britney said that he had a bruise on him, a family insider tells PageSix.com, adding, “And Britney said she did not do it.”

After the boy was examined and found to be fine, the hospital released him to father Kevin Federline.

“The boys are okay, just very shaken up,” says the family insider. “It took Kevin quite a while to get them settled down.”

Kevin’s mother, Julie Bleak, was also en route to K-Fed’s house to be with her grandchildren.

So where did all the drama begin? Apparently, yesterday’s deposition set the pop singer off. “Britney got angry as soon as it started. She pulled her normal thing and left,” says the insider.

Early reports are indicating that Britney Spears blood tests at Cedars-Sinai Medical Center came back negative meaning likely this incident was not precipitated by drug use. So where does this mental instability come from?  Sometimes it can just happen with the stresses of life but Britney’s family history predisposes her.
Britney’s paternal grandmother committed suicide at the age of 31 because she was depressed for years after the death of her baby. A doctor interviewed by US Magazine put the Spears family background and how it could affect Britney all in perspective:
“It means that there is a long history of serious mental illness in the family. Britney is behaving very bizarrely, she has been admitted to a chemical dependency program, she has a stressful career, she’s divorced, she has childcare demands, and she is in denial and is paranoid. She has a mom with the proxy relationship and a dad with drug addiction and alcohol problems. When you add that up you get the recipe for where she is today.”

Britney Spears has expressed her disappointed in her sister Jamie Lynn Spears for getting pregnant at 16-years-old.  Britney said she warned her sister to not jump into the “adult” world while she was still young. “I’m really disappointed in her. I told her over and over just to be a kid and let the adult things like sex and drinking and all that wait.”

“I just can’t believe she’s pregnant,” the 26-year-old added. “She’s way too young to be a mom.  She should be having fun and stuff, not having a baby.”

Meanwhile, Britney needs to cope and deal with her own problems, or soon go to jail.  The attorney for Kevin Federline says he wants to depose Britney Spears soon, the latest step in the former couple’s ongoing child-custody battle.

“Britney Spears will have her deposition early (next) year,” Mark Vincent Kaplan told People late Saturday outside a Beverly Hills restaurant. “We’ve got a lot to talk about.”

Spears, 26, called in sick to a court-ordered deposition Dec. 12, although she was photographed that day driving with a friend.

“She was, in fact, out later that day and night,” Kaplan said. “It’s not fourth grade where you get a doctor’s note and it’s all OK.”

Britney Spears also faces fresh frustration today as her ex-husband was spotted cosying up to party pal Paris Hilton. Paris hit LAX nightclub with her sister Nikki Hilton. She then spotted Kevin Federline at a VIP table with his family and friends. Hilton and Federline danced together before Paris grabbed her sister and headed to nearby Pure nightclub, where they were hosting their own party.

We thought about sparing you this news about K-Fed, but you come here because you love the pain. Admit it. The overly fertile wannabe rapper was partying this weekend in Las Vegas when he bumped into another inexplicable chick magnet: Wilmer Valderamma. Eyewitnesses say the deluded duo insisted on “rapping together to every song played.” We’ll pause while you groan. He then reportedly invited the Fez to collaborate with him on his next album. Why, oh why, does he insist on “entertaining” us?

Yes, it’s true: Paris and Fed-Ex were seen dancing at Tao Nightclub this weekend. I guess that reunion Federline was going to have with ex Shar Jackson didn’t go as planned — but why she would take him back, after he left her for Britney?

Federline was going to perform last week in an inflatable deodorant can, a stunt for AXE Body Spray — yes, that stuff your 13-year-old son thinks is going to get him girls! — but had to cancel because there were high winds. Bummer!

Despite the nightclubbing, rapping and spray wearing, 71 percent of respondents in an OK! Magazine poll believe K-Fed is a better parent than Britney. What do you think?
