Anna Nicole Smith’s baby daughter Dannielynn will inherit her late mother’s estate.  Superior Court Judge Mitchell Beckloff on Tuesday made 18-month-old Dannielynn Hope (who is recovering from eye surgery here) the sole heir, and also set up a trust in the girl’s name.

Her father, Larry Birkhead, and Smith’s lawyer and lover Harry K. Stern, will be co-trustees. Stern, filed the petition to clarify Smith’s intentions toward her daughter. Smith drafted the will in 2001 that left her estate to her then only child, Daniel. However, it said the assets in Daniel’s trust should be shared equally if she had future children. Daniel was 20 when he died in 2006, three days after Dannielynn was born.

“We and Mr. Stern always believed that Anna Nicole never intended to disinherit her daughter,” Stern’s lawyer, Bruce S. Ross, said after the hearing. “I’m pleased to say this chapter in the saga is closed.”

While Dannielynn becomes the sole benefactor, her mother’s estate itself is still under contention. Smith’s wealthy second husband, J. Howard Marshall, left much of his fortune (millions of dollars) to the model, but his relatives have been fighting the will for years.

The late Anna Nicole Smith and sperm donor Larry Birkhead’s 1-year-old daughter Dannielynn is “resting comfortably” after undergoing corrective eye surgery. Dannielynn, was diagnosed with strabismus (commonly known as a lazy eye), which cannot be outgrown and must be treated. Birkhead reported to Entertainment Tonight:
“Dannielynn is home from surgery and resting comfortably.”  “My thanks go out to Dr. Arthur Rosenbaum and the Jules Stein Eye Institute staff for taking great care of Dannielynn.”

Anna Nicole’s former bodyguard, Big Moe, recently sat down with Access Hollywood and had some interesting things to say about Larry Birkhead.

Big Moe claims that Anna Nicole viewed Birkhead as an ideal sperm donor because of his looks:

“Because of how Larry looked, she figured, oh my child would look great,” Big Moe told Access Hollywood’s Tony Potts. “Blonde hair, blue eyes, you know, ‘Go great with me and my baby will come out beautiful.’”

“So basically, from what she told you and what you’re telling me is that Anna looked at Larry as a sperm donor to get a really beautiful child?” Tony asked.

“That’s it,” Big Moe said.

Big Moe also added fuel to the gay rumors surrounding Birkhead, which he has vehemently denied. According to Big Moe, Anna told him that due to Birkhead’s “lifestyle” there would be no strings attached:

“What’s his lifestyle?” Tony asked.

“Well, she told me that, you know, he was a homosexual,” Big Moe said. “She knew deep down that he didn’t want to be with her.”

Is Birkhead hiding something?  Stories do keep coming up doubting his sexual orientation.  Rita Cosby claimed in her Anna Nicole Smith book that Howard K. Stern and Birkhead were gay lovers.  The National Enquirer claimed Kerrick Ross — a handsome male model carried on a torrid two-month sexual affair with Birkhead.

 Anna Nicole Smith’s successful sperm donor, Larry Birkhead, journeyed to the Bahamas with his daughter, Dannielynn, to visit the grave of her mother, one year after the star’s untimely death. And, of course, he brought along Entertainment Tonight (Jann Carl) to  intrude on witness the mourning.  Birkhead afterwards sat down with E.T., and the entertainment show is gonna carry the interview over a few episodes. I don’t know what annoy’s me more, Birkhead allowing, and I am assuming, profiting off of his daughter and her famous mother’s death. Or E.T.’s questionable judgement in choosing to provide this sensationalistic coverage. California authorities searched six locations, including pharmacies and the homes and offices of two doctors, on Friday in connection with the sudden death of Anna Nicole Smith last February in a Florida hotel room.The searches, in Los Angeles and Orange Counties, are related to drugs prescribed for or medical care provided to Ms. Smith, a former Playboy model, or those close to her before she died on Feb. 8 at the Hard Rock Hotel and Casino in Hollywood, Fla.

At a news conference in Los Angeles on Friday, California’s attorney general, Jerry Brown, said no arrests had been made. The searches, Mr. Brown said, grew out of an investigation into Ms. Smith’s death that was begun on March 30 by the Bureau of Narcotic Enforcement in the California Department of Justice. The inquiry, he said, included “the prescribing and dispensing practices of several California-licensed doctors and pharmacies.” He would not identify them.

The Associated Press reported that Ellyn Garafalo, a lawyer for Dr. Sandeep Kapoor, who had prescribed methadone to Ms. Smith shortly before she died, confirmed that the doctor’s home and offices were among those raided. Ms. Garafalo would not comment further.

Agents from the California Department of Justice answered the door at the office of a psychiatrist who treated Ms. Smith, Dr. Khristine Eroshevich, but would not say why they were there. A spokesman for the department had no comment.

An autopsy performed in Florida found that Ms. Smith, 39, died of an accidental overdose of methadone, antibiotics, anti-anxiety medication and other drugs, all of which had been prescribed.

At the time of her death, Ms. Smith was still mourning her son, Daniel, 20, who died from a drug overdose last September, days after his mother gave birth to a daughter, Dannielynn.

Larry Birkhead filed a lawsuit against his former attorney Debra Opri for cheating him out of hundreds of thousands of dollars. In the lawsuit, he seeks over $800,000 in damages including punitive damages. This in response to her $600,000 lawsuit in which she claims that he owes her for representing him in the custody case involving Dannielynn. We say: leave the poor man alone to do his new job as a daddy! Whose side are you all on?

ET is reporting that Dannielynn Smith, the most popular baby under the age of 1 ever, is officially Dannielynn Hope Marshall Birkhead as of today. That means only 17 years before her senior prom date has to come to the door asking for Dannielynn. Awwh, how time flies.

That’s how long we’ll have to wait until DNA results are in on Dannielynn Smith, Anna Nicole’s baby daughter. I know, it’s next week, but hasn’t this been going on long enough? After Howard K. Stern said he’d challenge the results (before they were in… does he have THAT MUCH doubt, or is he protecting what’s left of his late spouse’s reputation?) I figured the judge might release them just to get everyone to pipe down about it. Evidently, I figured wrong.

And if little Dannielynn belongs neither to Stern nor to Larry Birkhead, well, it could be months. Is this Anna Nicole’s way of getting back at the rest of us for being obsessed with her sex life? If she wanted to leave a mystery for the ages, I wish she’d buried a treasure Da Vinci Code-style. That would be more fun than contemplating the fate of this poor girl who, in any case, will never remember her mother.
