Unbelievable another judge lets Lindsay Lohan out of jail
(HMG Celebrity News) – Just when I thought California’s well deserved reputation for having judges with no backbones had been disproved, this happens. Instead of once again letting Lindsay Lohan make a mockery of the legal system, Judge Elden Fox took a stand and shockingly denied her bail. Her recent offense, where she failed two drug tests, one of which she tested positive for cocaine, was somehow considered a misdemeanor offense, so it was expected she would have to get bail. In that case it’s likely Judge Fox would later sentence Lindsay to 30 days in jail, but it would be subject to the realities of prison overcrowding, which means she would go to jail for booking and probably be released an hour or two later. But by denying bail, Lindsay could have been sitting there until October 22, for a next hearing. Judge Fox didn’t even give Lindsay’s lawyer a chance to object, so attorney, Shawn Chapman Holley, filed a late-afternoon appeal seeking bail. Judge Patricia Schnegg, who is an assistant supervising judge of LA’s criminal courts, issued a ruling early last night, saying that since Lohan had been convicted of misdemeanors, she was entitled to bail, which was immediately posted. She will however be required to wear an ankle alcohol monitor and stay away from establishments that primarily sell alcohol, which admittedly could put a crimp in her style. She will still have to report back in court on Oct. 22, when Judge Fox will get a chance to sentence her to jail time, but of course he will now be powerless to keep her their with the whole over crowding issue. What a joke the legal system is. Lohan was in jail in the first place for snubbing her nose at her probation conditions. After jail and rehab time, where idiot doctors let her loose early, she goes and uses coke, and this is a misdemeanor, and she doesn’t go right back to jail? Well why bother with the damn ankle bracelet now, if it doesn’t mean a hill of beans if she drinks again? And congratulations Judge Patricia Schnegg, for quickly restoring my complete contempt for California’s legal system, especially when it applies to celebrities.






The law is that misdemeanor charges entitle the person to bail (celebrity or no). Would it restore your belief in the judicial system if judges deliberately ignored the law?
I totally get what you’re saying. But it’s just another legal technicality, that allows lawyers to easily maneuver around the system. Judge Fox took a stand against an obviously flawed law. How can using cocaine be a misdemeanor offense, especially for someone who just got out of rehab and is on strict probation? Not to mention Lohan tweeted her admission to the failed drug test, while allegedly drunk. So you’re right the other judge was probably forced to overrule and give bail. But then why waste tax payer money on ankle bracelets and drug tests, if the law cannot be enforced? And by the way, people with money, which of course includes celebrities, make a mockery of these situations, because they can always come up with any amount of bail money, and they have high powered lawyers always at their beckon, to exploit every flaw in the legal system. So yes celebrities in essence do get special treatment, and “the law is not the law”. It is just full of unintended loopholes that crafty lawyers exploit.
The state constitution is not a “technicality”. Art 1, Sec 12 states bail can only be prohibited in death penalty and select felony cases. http://www.leginfo.ca.gov/const.html
Stick to your fluffy gossip stuff and leave the serious stuff, like what the law does and does not say, to the adults, ok?
Just another way those that HAVE get away with stuff. Us little people would rot in jail. It seems to me it was a VOP, here in Florida that’s an immediate GO TO JAIL and throw away the key!
That is because Art 1 sec 14 of the FL constitution only guarantees bail for pretrial actions. Different state, different constitution. Stick with the gossip, not the law.

Not at all. Everyone is entitled to their opinion, just not their own facts. Fact is the CA constitution guarantees bail in this case because it is not a specified felony under Art 1sec 12. It has nothing to do with her celeb status.
how can it be that she is out of jail. Fox probably sentenced her with no bail because she violated probation. Not once, but several times. In TX, if you violate probation on any charge, you get jail with no bond. Fox is determined to make her responsible for her actions and the other judge must want to see her dead !!
