Brazil’s top judge orders Sean returned to his father David Goldman
(HMG) -Â Finally it looks like the five year ordeal may be over. Brazil’s chief justice has ordered that Sean Goldman be handed over to his father, David.
Chief Justice Gilmar Mendes lifted a stay on a lower court order last week that Sean be returned to his father, who lives in Tinton Falls, N.J.
The boy’s Brazilian grandparents and step-father might possibly appeal, but lawyers said their chances of success this time appear very slim.
9-year-old Sean Goldman, has been at the center of the long running international custody dispute, since his now-dead mom fled the United States with him in 2004. Since then Brazil has basically been defying the Hague Abduction Convention aimed a curbing cases of child abduction by parents.
Last Thursday a Brazilian Supreme Court judge stupidly blocked Sean’s return to the United States, saying the boy’s own will must be taken into account. The day before a panel of three Brazilian judges ruled that David Goldman should get his son Sean back, and must be handed over to him at the U.S. Consulate in Rio de Janeiro within 48 hours. The way this case has gone over the years until Sean is home nothing is certain, but this sure looks very promising.
