Tila Tequila alleged assault case triggered by love triangle? (Charges Now Dropped)

Published on September 11, 2009 at 2:15 PM

In what is now being labeled by those close to the case as a simple publicity stunt, Tila Tequila is due to meet with San Diego police today, to discuss the alleged assault by boyfriend and San Diego Chargers linebacker, Shawne Merriman last Sunday.

San Diego’s 10 News reports that the local DA’s office has returned the case file to the Sheriff’s Department, as numerous factors could not be explained.

After team practice last night, Merriman was asked for his view of the case, but declined to comment as inquiries were ongoing and he’d been advised not to talk. “I can’t comment  Soon, though,” he said

Meanwhile, Tequila [real name, Tila Nguyen] showed no such restraint, “He knows I’m not lying. But instead of focusing on football, all he does is keep releasing stories about me.” she said – in the 23rd tweet she has released on the case in one week.

San Diego’s Attorney, Gretchen Von Helms told reporters that Tequila should ‘use caution’ on her tweeting, because ‘anything she says online can be used against her in court’…Yeah, good luck with that!

According to folks who were there at the time, the alleged incident was the finale of very hot night:

During a party at his home in Poway the three-time Pro-Bowler adjourned to the bedroom with two other women. Tila walked in on their games and was invited to join. She declined Shawne’s…er, kind offer, and threatened to have sex with his team-mates instead.

Partygoers say this tantrum progressed to a point where a drunken Tequila promptly got naked, and then tried to leave. Merriman attempted to stop her – and that’s when she called 911. But instead of Police she called Paramedics, then faked a neck injury when those guys arrived.

No actual injuries, not even a bruise were found on, or reported by either side at the time. But Tequila repeatedly demanded the Medics transport her to the local ER.

Merriman now faces a court hearing on Tuesday. If no charges are filed after Tequila meets the cops this AM, that date will be scrubbed and the case will die there. He has not been invited to speak to detectives himself, but his attorney is  scheduled to meet them instead.

Update: District Attorney Bonnie Dumanis announced Friday afternoon there is insufficient evidence to prove beyond a reasonable doubt that Merriman committed a crime and decided not to file charges.
