Federal Judge rejects civil rights challenge in Britney Spears Case

A federal judge has thrown Britney’s conservatorship case back to state court. Jamie Spears was awarded conservatorship over his daughter by the state court but attorney Jon Eardley was trying to get the case moved to the federal court, claiming the state was violating Britney’s civil rights. In a written declaration, Eardley said he was hired by Britney Spears on February 12, and had spoken to her on several occasions. Federal District Judge Philip Gutierrez returned the case to state probate court and sent a rebuke to lawyer Jon Eardley, on his claims he represent Spears.
“Mr. Eardley fails to explain why he can bring this claim for her in the first instance. He cannot,” Gutierrez said in his three-page ruling. “Mr. Eardley had no authority to remove the case from state court. He is neither a party nor a defendant. While he claims to be Ms. Spears’s attorney, the probate court … found that she was incapable of retaining her own counsel.”
That last statement by the judge means the court feels Britney is still in no condition to look after her own life. Also the court did not award the conservatorship attorneys fees, which means it could cost Brit around $40,000 for what turned out to be a bogus case.
